Generators that generate more than 1,000 kilograms (kg) (2,200 pounds) of hazardous waste per month must remove their waste within 90 days of generation.

The following can be considered in determining whether or not a generator is in compliance with the 90-day rule.

• 1 – If a generator generates no more than 100 kg (220 pounds) of hazardous waste (or one kilogram of extremely or acutely hazardous waste) during a calendar month, the 90-day period does not begin until the generator has accumulated 100 kg (220 pounds) or one kg of extremely or acutely hazardous waste.
• 2 – There is not a 90 day time limit for generators of not more than 100 kg (220 pounds) / month that are not using a satellite accumulation area and have not yet accumulated 100 kg (220 pounds) of hazardous waste (or one quart of extremely or acutely hazardous waste).
• 3 – If the generator generates more than 100 kg (220 pounds) of hazardous waste (or more than one kg of extremely or acutely hazardous waste) during any calendar month, the 90-day period begins when any amount of hazardous waste first begins to accumulate in that month.
